1. DEFINITIONS

  • BIG SACK: This brand name refers to the company BSC Transports SA, located at Route de Puidoux 16, Grandvaux (VD), Switzerland.
  • BIG BAG / Bag: The term "BIG BAG" or "Bag" refers to the waste bags sold by BIG SACK to its Clients.
  • Collection / Pickup: Refers to the collection and removal of the BIG BAG by BIG SACK.
  • Logistics Partner: BIG SACK may use logistics partners for the collection of the bags.
  • Client: Any person purchasing a BIG BAG or ordering a collection from BIG SACK is considered a Client.

1bis. PURPOSE AND SCOPE

These General Terms and Conditions govern the sale of products (BIG BAGS) and the collection services offered on the website www.bigsack.ch. They apply to all orders placed by private or professional clients domiciled in Switzerland. Any order implies full and unconditional acceptance of these Terms and Conditions.

2. GENERAL PROVISIONS

2.1. Any quotation or price estimate provided by BIG SACK is for information purposes only and becomes binding only once confirmed in writing by BIG SACK. The prices indicated are based on the information available at the date of the quotation or estimate, and BIG SACK reserves the right to modify prices at any time without prior notice before accepting or rejecting a Client's order, even if the order has already been paid. Likewise, the dimensions of the BIG BAGS are approximate and provided for information only.

2.2. All transactions with BIG SACK are governed by these General Terms and Conditions, which shall apply to the exclusion of any other terms. By placing an order or requesting a collection, you acknowledge that you have read, understood, and unconditionally accepted these General Terms and Conditions.

2.3. BIG SACK shall not be held liable for delays or other failures resulting from force majeure, meaning circumstances beyond BIG SACK's reasonable control, or which are neither foreseeable nor objectively attributable to BIG SACK. In the event of a delay resulting from force majeure, BIG SACK shall fulfil its obligations as soon as reasonably possible.

2bis. PRICES, PAYMENT AND INVOICING

Prices are stated in Swiss Francs (CHF), all taxes included (VAT included). Payment must be made online at the time of ordering, by credit card, TWINT or any other method offered by our secure payment provider Stripe. Orders are only considered valid once full payment has been received.

In the event of an obvious pricing error, BIG SACK reserves the right to cancel the order and refund the Client. Invoices and order confirmations are sent electronically to the email address provided by the Client.

3. PLACING BIG BAGS ON PUBLIC PROPERTY

3.1. It is generally necessary to obtain a municipal, cantonal or federal permit to place a BIG BAG or a skip on public property. If you do not have a valid permit, your BIG BAG may be removed before you have filled it and/or you may incur a fine. Such fines are entirely at the Client's expense. It is the Client's responsibility to enquire about any permits required and to complete the necessary procedures with the competent authority. No permit is usually required if the BIG BAG is placed on private property, such as a driveway or garden. In addition to permit-related costs, if a BIG BAG is to be placed on a paid parking space (parking meter, controlled parking zones, etc.), the Client is responsible for all procedures to suspend the parking space and must pay all related fees to the competent authority. Likewise, if a BIG BAG is placed on a private parking space (visitor space or allocated space), the Client is responsible for obtaining permission from the owner or property management and must cover any related costs.

4. DELIVERY OF BIG BAGS

We dispatch our BIG BAGS on the next working day following the order date. All BIG BAGS are shipped via Swiss Post. We do not guarantee delivery times, but we aim to deliver your order as quickly as possible. We only ship BIG BAGS within Switzerland.

5. USE AND STORAGE

Although our BIG BAGS are strong, they may become weakened if not stored or used carefully. Check your bag after unpacking it and notify us immediately if you identify a defect. Avoid piercing or tearing the BIG BAG during use. Do not use the bag for sharp objects, hot ashes or anything that could damage it. Our BIG BAGS are single-use and will not be replaced.

6. POSITIONING THE BAG

Place the bag in the spot where it will be collected by our truck before you start filling it. You may not be able to move it afterwards. Moving the BIG BAG may damage it or cause injury.

When using your BIG BAG, please place it within 4 metres of the public road. The public road must be at least 4 metres wide and easily accessible for a truck. Please also note that our trucks do not drive on cobblestones due to the risk of damaging the road surface.

Keep in mind that your BIG BAG will be collected by a large truck, which may exceed the size of a fire engine. If you have any doubts regarding accessibility, please contact us before ordering your collection. Additional charges may apply if the collection fails due to difficult access or if smaller vehicles must be used to remove your BIG BAG.

The bag must also be kept away from walls, trees, parked cars, overhead power lines (especially tram or trolleybus lines) and any other elements that may hinder the collection using a crane or mechanical arm.

Please do not place your BIG BAG on public roads or pavements without obtaining prior permission from your local authority.

The Client must also ensure that the BIG BAG is stored sheltered from rain to avoid it filling with water in bad weather.

7. FILLING THE BIG BAG

Distribute your waste and its weight evenly inside the bag. Do not overload the bag or fill it above the top edge. Our BIG BAGS can hold a maximum of 1.5 tonnes. If the bag is overfilled, an additional charge will apply. If in doubt, please contact us before purchasing your bag or ordering your collection.

Note: Our BIG BAGS are intended solely for the disposal of bulky waste, garden waste and construction waste. The bag must not be used for hazardous or special waste. Hazardous or special waste includes, in particular: asbestos, fridges, freezers, batteries, electrical appliances, gas cylinders, liquids, chemicals, spring mattresses, and clinical or food waste. These types of waste are more expensive to recycle or dispose of. If we find any such waste in your bag, an additional charge will apply. You should also be aware that if you fail to declare such waste or do not comply with these guidelines, you may be in breach of Swiss environmental laws. If in doubt, please contact us before purchasing your bag or starting to fill it.

Please also note that plasterboard cannot be accepted if mixed with other waste. Any plasterboard must therefore be stored in a separate bag dedicated solely to this type of waste. We will only collect plasterboard if it is separated into its own BIG BAG.

8. COLLECTION OF YOUR BIG BAG

You may order the collection of your BIG BAG either directly on our website www.bigsack.ch or by telephone. The collection will be carried out by a logistics partner. When placing your order, please specify the exact location of your BIG BAG so that it can be easily found by our driver or logistics partners. Please also inform us of the number of BIG BAGS to be collected and ensure that the road is sufficiently wide for our collection truck (at least 4 metres), indicate any possible obstacles or issues, and whether you need to be present at the time of collection.

We do not commit to collecting your BIG BAGS simply because you have purchased them. When a collection is ordered, we reserve the right to refund your order without justification within 7 days. It may occur that we are unable to collect your bag, in particular if the collection location is too remote.

We aim to collect your bag within 15 working days from the day following your request. However, this timeframe cannot be guaranteed and may be extended, but we will always keep you informed.

Please note that the price of the collection will be confirmed by telephone. Price variations may apply in certain areas (for example based on postcode). If you are unsure about your geographical area, please contact us before buying the bag or ordering the collection, and we will confirm the collection price for you.

9. ACCESSIBILITY

Please ensure that our driver or logistics partner can access the BIG BAG at any time between 6:00 and 21:00, seven days a week, even if no one is present on site. Please note that we reserve the right to refuse collection if a bag has been placed out of reach of our vehicle or that of our logistics partner. We also reserve the right to refuse collection if the truck must drive over cobblestones, if crane operation is obstructed, if our driver or partner cannot access the site, or if the bag is overloaded, overfilled, damaged or contains anything other than ordinary garden or construction waste (see "Filling the BIG BAG" section above).

Please inform our staff at the time of booking the collection of any restrictions that may apply at the site, such as no-parking zones, no-waiting zones, etc.

If the collection cannot be completed for any of these reasons, you may not receive a full refund. The mere dispatch of our trucks or logistics partners to your collection site incurs significant costs.

10. REFUND POLICY

We hope that you will not change your mind, but if you do, you have up to 28 days to return your BIG BAG and request a refund. Simply contact our customer service team and return your BIG BAG unused and folded in the same manner as when you received it. Please note that the return shipping costs will be at your expense. Upon receipt, we will refund you in full.

Collection orders may only be cancelled up to 5 working days before the scheduled collection date communicated to you, and no later than 2 working days after your order.

11. LIMITATION OF LIABILITY

11.1. To the fullest extent permitted by applicable law, BIG SACK shall not be held liable for any loss or damage caused to the Client's property. In any event, BIG SACK shall not be liable to the Client for indirect losses (including loss of profits and/or damage to goodwill), economic losses and/or any similar losses, special damages, or any direct or indirect losses, business interruption, loss of business, or loss of opportunity.

11.2. The Client agrees to use their best efforts to resolve any issue or dispute that may involve BIG SACK and shall not incur any expenses potentially chargeable to BIG SACK without BIG SACK's prior written consent. Failing this, all costs shall be borne by the Client.

11.3. BIG SACK accepts no liability towards the Client if the amounts owed by the Client have not been paid in full by the due date.

11.4. BIG SACK endeavours to deliver the equipment at the time requested by the Client and to respect the collection dates. Any time estimates provided by BIG SACK are only approximations, and BIG SACK shall not be held liable for any delay, regardless of cause.

11.5. In any event, BIG SACK's total liability is limited to the amount actually paid by the Client for the order concerned.

12. RISK AND TRANSFER OF OWNERSHIP

12.1. Risk in the equipment (including the BIG BAGS) transfers to the Client immediately when the equipment leaves the physical possession or control of BIG SACK.

12.2. Ownership of the equipment transfers to the Client only after full payment of the purchase price has been received.

13. DATA PROTECTION

13.1. The processing of personal data by BIG SACK is governed by the Privacy Policy available on www.bigsack.ch.

13.2. Data collected is used exclusively for managing orders, deliveries, payments and client communications.

13.3. BIG SACK does not sell personal data to third parties. Service providers (hosting, logistics, payment, etc.) are required to comply with legal data security and confidentiality standards.

14. INTELLECTUAL PROPERTY

All elements of the website www.bigsack.ch (texts, logos, trademarks, images) are protected by copyright and remain the exclusive property of BSC Transports SA. Any reproduction, distribution or unauthorised use is prohibited.

15. ELECTRONIC COMMUNICATIONS

By placing an order on www.bigsack.ch, the Client agrees that all communications (confirmations, invoices, information) may be sent electronically to the email address indicated when placing the order.

16. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

BIG SACK reserves the right to amend these General Terms and Conditions at any time. The applicable version is the one published on www.bigsack.ch at the time of the order.

17. CONSUMER PROTECTION

In the event of any conflict between these General Terms and Conditions and mandatory provisions of Swiss consumer protection law, the latter shall prevail.

18. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Swiss law, excluding its conflict of laws provisions. The exclusive place of jurisdiction is Lausanne (VD), Switzerland.
